Terms of Service
Kandiverse (Canada)

1. Agreement to Terms
By downloading, installing, or using Kandiverse (the "App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Who May Use Kandiverse
Users 13 years of age or older may create their own account. Children under 13 may only use the App under direct parental supervision, with the parent accepting these Terms on their behalf.
By creating an account you confirm you are at least 13, or that you are a parent/guardian accepting on behalf of your child. If you permit a child under the age of majority in your jurisdiction to use the App, you accept full responsibility for their use.
3. The Service

The photo-to-pattern converter turns images into Perler-bead patterns using on-device processing only. In this flow, no raw photo is ever sent to our servers.

AI Create is an optional feature that turns a text prompt or an uploaded reference photo into a new pixel-art bead pattern using third-party AI image generation (OpenAI). When you use AI Create, your prompt, description, and any reference photo you upload are transmitted to our servers and to OpenAI solely to generate your pattern. See our Privacy Policy for details.

AI Create is subject to generation limits by plan: free accounts receive a daily allowance, and Pro and Pro+ subscriptions include larger monthly allowances, as shown in the App. Limits are enforced server-side and may change with reasonable notice.

Free accounts may save unlimited designs to the community gallery, where they are publicly visible to other users. Saving a design privately (visible only to you) requires an active paid subscription.

A paid subscription (Pro or Pro+) unlocks unlimited private design saves, a larger AI Create allowance, and any other premium features described in the App at the time of purchase. If your subscription lapses, private designs are retained but you must make a design public to continue editing it, or resubscribe to keep it private. Quota and entitlement are enforced server-side.

We may modify, suspend, or discontinue any part of the App at any time with reasonable notice to paid subscribers.
4. Subscriptions, Billing, and Refunds
Subscriptions are billed in advance on a recurring basis (monthly or annual). Billing is processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on the applicable recurring schedule.
You may cancel at any time through the App or by emailing support@kandiverse.com. Cancellation takes effect at the end of the current billing period.
Refund rights by region:

Canada: You may be entitled to a refund within 7 days of purchase if the service is substantially not as described.
•
EU / EEA / UK: Consumers have a 14-day right of withdrawal. Contact support@kandiverse.com to exercise this right.
•
Australia: Refund rights apply under the Australian Consumer Law where services are not of acceptable quality.
•
Other jurisdictions: Where local consumer protection law grants statutory refund rights, those rights apply and are not waived by these Terms.
Price changes will be communicated at least 30 days in advance. Continued use after a new price takes effect constitutes acceptance.
5. Intellectual Property
The App, its name, logo, and all content created by Kandiverse is owned by or licensed to Kandiverse and protected by Canadian and international intellectual property law.
Your designs (private): Bead-pattern designs you keep private remain your content. By storing a private design on our servers, you grant us a limited license to host and transmit it solely to provide the service to you.
Public designs: When you publish a design to the community gallery or otherwise make it publicly visible in the App, you grant Kandiverse and its successors a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, display, perform, adapt, and create derivative works from that design for any purpose, including marketing, promotional, and commercial uses, without further notice or compensation to you. You retain copyright ownership of your original work, but you waive any right to restrict or revoke Kandiverse's use of publicly shared designs.
By making a design public you confirm you own all rights to it and that it does not infringe any third-party intellectual property rights.
AI-generated patterns: Patterns you create with AI Create are treated like any other design you make, and the private/public license terms above apply to them. Because generative models can produce similar output for similar prompts, we cannot guarantee that AI-generated patterns are unique, and other users may independently generate similar patterns. You are responsible for the prompts, descriptions, and reference photos you submit, and you must have the right to use any photo you upload. Patterns depicting third-party characters, logos, or trademarks may be subject to the rights of those third parties, and you are responsible for how you use them.
6. Acceptable Use
You agree not to:

Use the App for any unlawful purpose
•
Reverse-engineer, decompile, or disassemble the App
•
Circumvent quota enforcement, security features, or authentication systems
•
Use bots or automated tools to scrape or access the App
•
Create multiple accounts to circumvent free-tier limits
•
Upload or generate content depicting illegal content or hate speech
•
Submit prompts, descriptions, or images to AI Create intended to produce unlawful, hateful, sexually explicit, or infringing content
•
Upload photos of other people to AI Create without their permission
•
Introduce malware or harmful code
Violations may result in immediate account suspension or termination without refund.
7. Privacy
Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you also agree to the Privacy Policy.
8. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis. Kandiverse disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
In jurisdictions that do not permit exclusion of implied warranties (including many Canadian provinces, EU member states, UK, and Australia), statutory consumer guarantees continue to apply.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Kandiverse will not be liable for indirect, incidental, special, consequential, or punitive damages. Kandiverse's total liability will not exceed the greater of: (a) amounts you paid in the 12 months preceding the claim, or (b) CAD $100.
Where applicable law does not permit limitations of liability for personal injury or consumer statutory rights, those limitations do not apply.
10. Modifications to Terms
We may modify these Terms from time to time and will revise the Effective date above. Minor changes take effect when posted; for material changes we will provide notice in the app and/or by email before they take effect, giving advance notice where required by law. Continued use after changes take effect constitutes acceptance. If you disagree, you may stop using the App and request account deletion.
11. Termination
You may delete your account at any time through App settings or by emailing support@kandiverse.com. We may suspend or terminate your account for violations of these Terms, legal requirements, or if we discontinue the App.
12. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Before formal dispute, please contact support@kandiverse.com to attempt informal resolution. Unresolved disputes will be submitted to arbitration administered by the ADR Institute of Canada, or resolved in Ontario courts at our election.
Nothing limits your rights under mandatory consumer protection legislation in your jurisdiction. EU/EEA/UK consumers may bring disputes before the courts of their country of residence.
13. General
•
These Terms and the Privacy Policy are the entire agreement between you and Kandiverse.
•
If any provision is found invalid, the remaining provisions continue in force.
•
Our failure to enforce a provision is not a waiver of that right.
•
